Terms and Conditions

These Terms and Conditions govern the use of the A-Line Wellness website and the purchase of products through our online store.

Please read these Terms and Conditions carefully before placing an order. By placing an order through the website, you confirm that you have read and accepted the Terms and Conditions applicable at the time of purchase.

Nothing in these Terms and Conditions limits any mandatory consumer rights available under applicable law.

A-Line Wellness is operated as a sole trader / self-employed business in Portugal.

Where applicable, A-Line Wellness operates under the Portuguese VAT exemption regime in accordance with Article 53 of the Portuguese VAT Code.

2. Scope

These Terms and Conditions apply to purchases made through:

www.a-linewellness.com

They apply primarily to consumers purchasing products for personal use.

A consumer is a natural person acting for purposes outside their trade, business, craft or profession.

Separate terms may apply to wholesale, professional or business purchases.

3. Products

A-Line Wellness offers wellness, cosmetic, personal-care and related products through the online store.

We make reasonable efforts to present product descriptions, ingredients, quantities, images and instructions accurately.

Minor differences in colour, packaging, appearance or presentation may occur because of:

  • screen settings;
  • natural variations in ingredients;
  • packaging updates;
  • small-batch production;
  • supplier changes that do not materially affect the product.

Such minor differences do not affect your statutory rights where a product is defective, unsafe, incorrect or materially different from its description.

Product images are for illustrative purposes and may not always represent the exact size or appearance of the delivered product.

4. Product Use and Safety

Customers must read and follow all product labels, ingredients, warnings, storage instructions and usage directions before use.

Products must be used only for their intended purpose.

Information on this website is provided for general informational purposes and does not constitute medical advice, diagnosis or treatment.

Customers should seek advice from a qualified healthcare professional before using a product where they:

  • are pregnant or breastfeeding;
  • have allergies or sensitivities;
  • have an existing medical condition;
  • are taking medication;
  • are unsure whether a product is suitable for them.

A-Line Wellness does not guarantee that a product will produce the same result for every customer.

Nothing in this section excludes liability for a defective or unsafe product or limits mandatory consumer rights.

5. Eligibility to Purchase

To place an order, you must:

  • be at least 18 years old or have permission from a parent or legal guardian;
  • provide accurate and complete information;
  • be legally capable of entering into a binding contract;
  • use a valid payment method that you are authorised to use.

We may refuse or cancel an order where we reasonably suspect fraud, misuse, unauthorised payment or unlawful activity.

6. Placing an Order

Products are selected and added to the shopping cart.

Before submitting the order, you will be able to review and correct:

  • selected products;
  • quantities;
  • delivery details;
  • shipping method;
  • total price;
  • payment information.

By clicking the final order button, you submit a binding offer to purchase the products in your cart.

The wording of the final order button must clearly indicate that placing the order creates an obligation to pay.

After placing an order, you will receive an automated order confirmation by email. This confirms that we have received the order but does not necessarily mean that the order has been accepted.

A contract is concluded when we:

  • send a separate shipping or acceptance confirmation; or
  • dispatch the ordered products,

whichever occurs first.

7. Order Refusal or Cancellation

We may refuse or cancel an order before dispatch where:

  • the product is unavailable;
  • the price or product information contains an obvious error;
  • payment cannot be authorised;
  • delivery to the supplied address is unavailable;
  • we reasonably suspect fraud or unlawful activity;
  • the quantity ordered indicates unauthorised resale or commercial use;
  • fulfilment would breach applicable law.

Where payment has already been collected, the relevant amount will be refunded using the original payment method.

We will not cancel an accepted order merely because fulfilling it has become less profitable or commercially inconvenient.

8. Product Availability

All orders are subject to product availability.

Placing an item in the shopping cart does not reserve it.

If a product becomes unavailable after an order has been placed, we will contact the customer and offer, where appropriate:

  • cancellation and a full refund;
  • a suitable alternative with the customer’s agreement;
  • partial fulfilment and a refund for unavailable items.

We will not replace a product with a materially different product without the customer’s consent.

9. Prices

Prices are displayed in the currency shown on the website.

The total price payable will be displayed before the customer submits the order and will include:

  • the product price;
  • applicable taxes, where charged;
  • shipping costs;
  • any other mandatory charges collected by A-Line Wellness.

Where A-Line Wellness is legally exempt from charging Portuguese VAT, prices will be displayed without separately charged VAT.

For deliveries outside the European Union, customs duties, import taxes and carrier handling charges may apply. Unless expressly collected during checkout, these charges are not included in the purchase price and may be payable by the recipient.

10. Pricing Errors

We make reasonable efforts to ensure that prices are accurate.

If an obvious pricing error is discovered before dispatch, we may cancel the affected order and refund any amount already paid.

An error is considered obvious where a reasonable customer should have recognised that the displayed price was clearly incorrect.

We will not charge a higher price without first obtaining the customer’s express agreement.

11. Payment

Available payment methods are displayed during checkout.

Payment may be processed by Shopify Payments or another authorised third-party payment provider.

By submitting payment details, the customer confirms that:

  • the information provided is complete and accurate;
  • they are authorised to use the payment method;
  • sufficient funds or credit are available.

Orders may be delayed or cancelled if payment is rejected or cannot be verified.

A-Line Wellness does not store full payment-card details where those details are processed directly by the payment provider.

12. Shipping and Delivery

Orders are shipped according to our separate Shipping Policy, which forms part of these Terms and Conditions.

Estimated processing and delivery times are displayed in the Shipping Policy and during checkout where applicable.

Delivery times are estimates unless a specific binding delivery date has been expressly agreed.

The customer is responsible for providing a complete and accurate delivery address.

Where a parcel is returned because of an incorrect address, failure to collect it or unjustified refusal of delivery, reasonable additional costs actually incurred may be charged or deducted from a refund where permitted by law.

This does not apply where the failed delivery was caused by A-Line Wellness or the carrier.

13. Transfer of Risk

For consumer purchases, the risk of loss or damage generally passes to the customer when the customer or a person designated by the customer physically receives the products.

Where the customer independently appoints a carrier that was not offered by A-Line Wellness, risk may pass when the products are handed to that carrier, where permitted by applicable law.

14. Right of Withdrawal

Consumers generally have the right to withdraw from an online purchase within 14 calendar days after receiving the goods, without providing a reason, subject to legal exceptions.

  • how to exercise the right of withdrawal;
  • return deadlines;
  • return costs;
  • refund procedures;
  • non-returnable products;
  • the model withdrawal form,

is available in our Return and Refund Policy, which forms part of these Terms and Conditions.

The 14-day withdrawal right and the obligation to provide clear advance information are central requirements for EU distance contracts.

15. Hygiene and Personal-Care Products

The statutory right of withdrawal may not apply to sealed products that:

  • are unsuitable for return for genuine health-protection or hygiene reasons; and
  • were unsealed by the customer after delivery.

This exclusion does not apply merely because a product belongs to a health, cosmetic or personal-care category.

The exclusion applies only where the legal conditions are met and does not affect rights relating to defective, unsafe, incorrect or misdescribed products.

16. Damaged, Defective or Incorrect Products

Customers should inspect products after delivery and contact us promptly if a product is:

  • damaged;
  • defective;
  • unsafe;
  • incorrect;
  • incomplete;
  • materially different from its description.

Customers may be asked to provide photographs, the order number and a description of the issue.

A request to report visible shipping damage within 48 hours is intended to assist with carrier claims and does not remove statutory consumer rights.

Where a product does not conform to the contract, the customer may be entitled to legally available remedies such as:

  • repair;
  • replacement;
  • price reduction;
  • contract termination and refund.

The appropriate remedy depends on the circumstances and applicable law. Portuguese rules on conformity of goods and consumer remedies apply to consumer sales.

17. Returns and Refunds

Returns and refunds are handled in accordance with our Return and Refund Policy.

Approved refunds will generally be made using the original payment method unless another method is expressly agreed.

A-Line Wellness may withhold a withdrawal refund until the returned goods are received or until the customer supplies evidence that the goods were sent back, whichever occurs first, where permitted by law.

18. Promotions and Discount Codes

Promotional offers and discount codes may be subject to additional conditions displayed with the relevant promotion.

Unless otherwise stated:

  • discount codes cannot be exchanged for cash;
  • only one discount code may be used per order;
  • discount codes cannot be applied retrospectively;
  • expired codes cannot be used;
  • discounts do not apply to shipping unless expressly stated;
  • discounts may exclude specific products or collections.

Promotions will not affect statutory consumer rights.

19. Gift Cards

Where gift cards are offered, additional terms may be displayed on the relevant product page.

Gift cards:

  • may be used only through the A-Line Wellness store;
  • cannot normally be exchanged for cash except where required by law;
  • may not be resold without permission;
  • must be protected by the customer against unauthorised use.

Expiry dates, where applicable, will be clearly disclosed before purchase.

20. Website Use

You may use the website only for lawful purposes.

You must not:

  • interfere with the operation or security of the website;
  • attempt unauthorised access to systems or customer accounts;
  • introduce malware or harmful code;
  • scrape or extract website content on a large scale without permission;
  • use the website for fraudulent or unlawful purposes;
  • impersonate another person;
  • submit false or misleading information.

We may restrict access where reasonably necessary to protect customers, the business or the website.

21. Customer Accounts

Where customer accounts are available, customers are responsible for:

  • keeping login details confidential;
  • providing accurate information;
  • notifying us of suspected unauthorised access;
  • activity carried out through their account where caused by their failure to protect account credentials.

We may suspend an account where we reasonably suspect fraud, misuse, security risks or a breach of these Terms and Conditions.

22. Reviews and User Content

Customers may submit reviews, comments or other content where this functionality is available.

Submitted content must not:

  • be false or misleading;
  • infringe intellectual-property or privacy rights;
  • contain unlawful, abusive, discriminatory or defamatory material;
  • include malware, spam or unauthorised advertising.

We may moderate or remove content where reasonably necessary.

Where a customer grants us permission to use submitted content, the scope of that permission will be explained at the time of submission.

23. Intellectual Property

All website content, including:

  • product descriptions;
  • text;
  • photographs;
  • graphics;
  • logos;
  • videos;
  • branding;
  • layout;
  • design elements,

is owned by A-Line Wellness or used with permission from the relevant rights holder.

Content may not be copied, reproduced, modified, distributed or used commercially without prior written permission, except where allowed by applicable law.

24. Third-Party Links and Services

The website may include links to or services provided by third parties, including payment providers, shipping providers and social-media platforms.

A-Line Wellness is not responsible for third-party websites or services that it does not control.

This does not exclude responsibility where applicable law makes A-Line Wellness responsible for the acts of a selected service provider in connection with the customer’s order.

25. Website Availability

We aim to keep the website available and secure but cannot guarantee uninterrupted or error-free access.

We may temporarily suspend access for maintenance, security, technical or operational reasons.

Temporary website unavailability does not affect rights arising from orders already accepted.

26. Liability

A-Line Wellness is liable in accordance with applicable law.

Nothing in these Terms and Conditions excludes or limits liability for:

  • fraud or fraudulent misrepresentation;
  • intentional misconduct;
  • gross negligence;
  • death or personal injury caused by negligence;
  • defective or unsafe products;
  • breach of mandatory consumer rights;
  • any liability that cannot legally be excluded or limited.

A-Line Wellness is not responsible for losses caused solely by:

  • misuse of a product contrary to instructions or warnings;
  • incorrect information supplied by the customer;
  • events outside our reasonable control;
  • third-party services not selected or controlled by us.

Any limitation of liability applies only to the extent permitted by law.

The current sentence stating that A-Line Wellness is not liable for any direct, indirect or consequential damage should therefore be removed. Standard consumer terms cannot create a significant imbalance against the consumer and must comply with EU rules on unfair contractual terms.

27. Events Outside Our Reasonable Control

We are not responsible for delays or failures caused by circumstances outside our reasonable control, including:

  • severe weather;
  • natural disasters;
  • transport disruption;
  • strikes;
  • governmental restrictions;
  • customs delays;
  • major technical failures;
  • epidemics or public-health emergencies.

We will take reasonable steps to reduce the effects of such events and inform affected customers where appropriate.

Mandatory refund, delivery and consumer rights remain unaffected.

28. Personal Data

Personal data is processed in accordance with our Privacy Policy and Cookie Policy.

Customers should read those policies to understand:

  • what personal data is collected;
  • why it is processed;
  • how long it is retained;
  • which service providers receive it;
  • the customer’s data-protection rights.

30. Governing Law and Jurisdiction

These Terms and Conditions are governed by Portuguese law.

Where the customer is a consumer, this choice of law does not deprive them of mandatory protections available under the law of their country of habitual residence.

Disputes may be submitted to the courts having jurisdiction under applicable law.

Nothing in these Terms and Conditions requires a consumer to bring proceedings exclusively before the courts of Portugal where mandatory consumer-jurisdiction rules provide otherwise.

32. Changes to These Terms

We may update these Terms and Conditions to reflect changes in:

  • applicable law;
  • website functionality;
  • business operations;
  • payment or delivery services;
  • products and policies.

The updated version will apply to orders placed after the revised Terms and Conditions are published.

Changes will not normally apply retroactively to orders already concluded unless:

  • required by law; or
  • expressly agreed with the customer; or
  • the change is more favourable to the customer.

The date of the latest update will appear at the top of this page.

33. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

The invalid provision will be interpreted or replaced only to the minimum extent necessary to comply with applicable law.
